Maximum fine for construction firm

A company has been fined the maximum amount for breaching their planning conditions on the Home Farm Housing Development in Llay.

The Magistrates Court fined the company £666, plus costs of £280 and Victim Surcharge of £266.

The planning permission for the development in Llay was subject to a range of conditions including a condition to restrict delivery times and hours of construction work.

Once construction was underway, Wrexham Council received complaints that it was taking place outside of the conditioned hours.  As a result, a Breach of Condition Notice was served on Bellway Homes in August 2023.

Further reports of working beyond the permitted hours were received following the serving of the Notice, so the planning department started prosecution proceedings for not complying with the Notice.  The company pleaded guilty.

Cllr Hugh Jones, lead member for strategic planning and public protection, said: “Planning conditions are put in place to ensure high quality developments and in this case, to minimise the effect of the construction works on nearby residents.

The planning department is committed to enforcing conditions imposed on planning permissions and taking prosecution action when required.”
