Wrexham County Borough Council have prosecuted 2 individuals in 2 separate Planning Enforcement cases:

  • A Planning Contravention Notice was served on the owner of a property in Llay.  The Notice required them to respond with information to aid the Council’s investigations into alleged breaches of planning control at the site.  The owner of the land failed to reply to the Notice.  He was ordered to pay a £40 fine, £280 costs and £16 victim surcharge;
  • The owner of a property in Gresford was prosecuted for failing to comply with the requirements of an Enforcement Notice to remove an extension of his domestic garden that projected beyond the boundary of the property and into the open countryside, together with the removal of the boundary fence erected around the unlawful garden area.   He was ordered to pay a fine of £400, £280 costs and £160 victim surcharge. 

Councillor Hugh Jones, Lead Member for Planning and Public Protection, said: “The outcome of these cases again demonstrates will respond robustly were planning regulations are breached. We will also will respond robustly where individuals attempt to frustrate investigations into breaches of planning regulations”

David Fitzsimon, Chief Officer for Economy and Planning at Wrexham Council, said: “These cases demonstrate that our Officers respond robustly to breaches of planning control by taking enforcement action, including prosecution, where it is expedient to do so.  Officers will also resort to prosecution where individuals fail to comply with statutory requirements to provide information to aid Officers investigate breaches of planning control”
